IMPORTANT LEGAL NOTICE. PLEASE READ THESE TERMS CAREFULLY BEFORE AGREEING TO PARTICIPATE IN THE FILMING FOR THE TOMBOLA EMMERDALE SPONSORSHIP IDENTS (BUMPERS) AS THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS.
I understand that my application including my answer for why I should be selected to feature in the sponsorships idents (bumpers) (which has been written solely by me and contains no excerpts from other sources) and my photo will be owned by tombola and can be made use of by tombola across media in the advertising of tombola (including but not limited to online use, TV Emmerdale Sponsorship, press, editorial use and tombola website) in perpetuity
If I am selected I agree that my travel expenses to and from the shoot will be covered up to a reasonable amount and I will paid upon submission of my receipt(s) on the day of the shoot. (Further details of expenses will be provided to players attending the day nearer the time). I agree that this fee shall also represent the total consideration due to me for the participating, at tombola’s request, in the filming of the Emmerdale Sponsorship idents for “tombola”. I confirm that I will make myself available for filming and / or Saturday 24th or Saturday 31st October 2009 (the shoot). I further agree that I can make one of these dates and that I know of no reason why I would fail to appear including but not limited to any pre existing medical condition &/or prior commitments
I hereby irrevocably grant to tombola and Euro RSCG (“Agency”) and their successors and assigns and to such other persons as tombola or Agency may designate from time to time, the absolute right to use my likeness and photograph(s), in whole or in part, or distorted in character or form, in conjunction with my own name, user name for tombola or a fictitious name for advertising, publicity, trade or any other lawful purpose whatsoever, in any media whatsoever now known or hereafter developed and in any territory
I acknowledge that the full copyright of the said film and all the rights of a like nature throughout the world are vested in tombola.
Application entries will only be received via the website and dedicated email address provided.
I understand this is not a competition or prize draw but an audition to take part in the tombola idents for Emmerdale sponsorship
I understand that tombola and the Agency will undertake further checks once my application is received. tombola and the Agency’s casting decision is final and subject to applications meeting certain criteria.
Note tombola is not obliged to select someone if no suitable candidates come forward.
I unconditionally waive any moral rights I may have in the idents (and any other statutory modification, re- enactment or replacement thereof and/or equivalent enactments or provisions elsewhere in the world)
I agree to keep confidential all details about the shoot and I agree not to publish in any manner or medium comments likely to discredit the tombola or the Agency
I confirm that, to my best knowledge and belief, there is no reason why I should not appear in these idents or anything that may discredit or damage the reputation of the product/service or advertiser by my participation.
I confirm that I have not been convicted of a criminal offence in the last 5 years (include any driving convictions).
I declare that I am over 25 years of age. (ITV request players look over 25 years of age)
I am currently in good physical and mental health and able to work
Please note that failure to disclose any and all material facts could result in you being personally liable for the recovery of associated costs. Material facts are any reason or impediment that may result in the schedule of the production being altered, cancelled or the final idents(s) being unable to air. These material facts could be, but are not limited to, a criminal record, a medical condition, being declared bankrupt, an expectant partner or a family member’s impending operation.
I agree to sign an agreement and return this to the Agency before I arrive at the shoot confirming I understand and accept the above terms and conditions.
