1 INTRODUCTION

The following sections explain the rules which govern all transactions that are effected through the www.tombola.co.uk website. Please read the terms carefully and ensure that you understand them fully, before agreeing to be bound by them.

In order to play games on www.tombola.co.uk, you will be required to register and make a deposit. Once registered and subject to satisfying verification, you can play the games. These terms and conditions will apply. 2 DEFINITIONS

2.1 THE GAMES
Pay to play games meeting the regulatory requirements of the Alderney Gambling Control Commission (AGCC). The Commission is independent and non political and regulates gambling on behalf of the States of Alderney.

2.2 PLAYER
A person who pays to enter one of the Games - also known as the 'Wagerer'.

2.3 PRIZES
Money or Goods won by a Player (also referred to as 'Winnings')

2.4 PRIZE POOL
Amount available for Prizes.

2.5 PROGRESSIVE JACKPOT

3 CHAT ROOM RULES

Our aim here at tombola is to provide chat rooms where players can have fun as well as feeling safe in a friendly atmosphere. Although the Chat Moderators are always on hand to offer gentle reminders to anyone who may break the rules, we feel it is important to have a set of rules listed on the site for players to read if they wished.

We created the list by taking feedback from the players and we hope that the majority of players will support the rules, which we have listed below. Please can we ask that all players observe the following chat room rules.

Drug Use Content – All promotion of drug related activities are not allowed in the rooms. However you are allowed to debate such a subject, providing it does not offend others
Other forbidden chat – promotion of any illegal activities such as hacking, sex talk, stalking, gang activities are also deemed unacceptable and can result in being permanently removed from the site
Maintain a friendly chat room by respecting others and by assisting and welcoming new chatters
By using the chat room, you grant us a non-exclusive royalty-free license to use, display and transmit such information in any and all media without any duty to account to you as a player
Don't use capital letters in Chat - it is seen as SHOUTING

CHAT GAMES PRIZES

Chat Moderators (CM's) will run quizzes throughout the day. Be the first person to answer a question and the CM will reward you with £1.00. The decision of the CM is final. You can win up to £2 per day with chat games, when you reach this level an asterisk (*) will appear by your username in the chat window. Each 24-hour period will begin at 4 am and the asterisk will then disappear.

To play Carnival, all players agree to the following terms and conditions.

4 REGISTRATION

4.0 UNDER-18s
You must be at least 18 years old in order to register and play any of the games on www.tombola.co.uk. We reserve the right to request your proof of age. In such instances where we suspect you maybe under 18, your account could be suspended pending investigation. We reserve the right to void and return any stakes placed by minors as well as remove anyone in chat whom we suspect maybe under age.
You must personally register your own account and should not register for anyone else or disclose your log in details to anyone. To play the pay to play games you are required to enter payment details securely. You must only make deposits and withdrawals using your own registered payment method.

4.1 INTERNATIONAL ACTIVITY
The games that are featured on tombola can only be played in the UK. Some countries prohibit some or all of the forms of gambling available on this site. Tombola does not intend that persons located in a jurisdiction in which such registration and/or playing any of the games is unlawful or contrary to any applicable regulation at the time of registration should play the games. 4.2 IDENTIFICATION
In accordance with the legislation laid out by the States of Alderney, we may use the information you have given us, or we already hold about you, or which we receive from any enquiry we may make with agencies to confirm your identity. The process enables us to open accounts quickly whilst verifying your age and identity and assists in fraud prevention. We will check any details you disclose against any databases (public or private) to which we have access and will keep a record of that check. We will also retain your personal information and may use it in the future to assist other companies with identity verification. You agree that we may process, use, record and disclose personal information, which you provide in connection with your registration, and that such personal data may be recorded by the credit reference agencies or us.

4.3 PERSONAL IDENTIFICATION PASSWORD
On registration you are assigned a unique User ID along with your own choice of password. It is your responsibility to ensure you do not reveal your User ID and/or Password to anyone else. You are responsible for any stakes placed where your User ID and Password have been correctly entered.

4.4 FORGOTTEN PASSWORD
Should you have forgotten your password or suspect that someone else has learned of your unique User ID, please contact our Customer Service team immediately.

4.5 REFUSAL OF REGISTRATION
We reserve the right to suspend or close your account and refund any balance of your account without further explanation. In this instance any outstanding credits will be honoured.

4.6 ENTERING CARD DETAILS
You are required to register a credit/debit card to your account in order to commence gaming. The credit/debit card you use for your first deposit card will become the registered credit/debit card for your account and will be used for future deposits and withdrawals. Subsequent deposits will require you to only enter the amount you wish to deposit and the same card details that were registered to your account will be used to take the payment. Please note that for security reasons tombola does not store your card details in a retrievable format. Card details are stored using a secure one-way encryption algorithm, which means that the original details cannot be obtained from the encrypted data. The actual card details are held securely by our approved payment provider, which allows us to enable you to process future transactions without the need to re-enter your card details. If you need to change your registered card details (for example, you may have a new card number) then you can do this in the my account area or you can contact Customer Services. MasterCard users should also note that withdrawals to a MasterCard are not permitted, so any withdrawals you wish to make can only be paid by cheque.

4.7 SECURE COMMUNICATIONS
When you send confidential personal account data (including credit/debit card details) to us, we require that a "secure session" be established first using Secure Socket Layer (SSL) technology. This means that data passed back and forth between your computer and our systems is secured using public key cryptography. Your computer exchanges key information with our servers to create a private conversation that only your computer and our servers can understand. Our links with our payment gateway (a leading UK e-commerce payment company) uses the same technology to transmit any payment information securely. 4.8 ONE ACCOUNT PER PLAYER
It is the intention of tombola that an individual should have a maximum of one account with www.tombola.co.uk. tombola prohibits individuals from opening more than one account.

4.9 PLAYER RESPONSIBILITY
It is the players’ responsibility to keep your personal details private at all times. Players are responsible for all gaming transactions actioned through their account where all personal details have been correct when entered by the person placing the wager. You should also log out when you have finished playing.

4.10 UPDATING CARD DETAILS
Account holders are also responsible for keeping accurate details provided at registration up to date. You can access and amend your own individual account information by clicking on "Credit Account", then "Update Card Details" in the "My Account" area of the site. If you have any questions please contact our Customer Services, who will be pleased to help you. Account holders are responsible for all gaming transactions actioned through their account where the person wagering has entered the correct user name, password and personal question details. 4.11 INTEREST ON PLAYER ACCOUNT FUNDS
Interest will not be payable on monies held in customer accounts as these are deemed to be advance payments for intended wagering.



5. YOUR ACCOUNT

5.1 DEPOSITS BY CARDS ONLY
You can deposit money into your account to play the Games using VISA/ MasterCard credit cards, Switch/ Maestro, Visa Delta, Visa Electron and Solo, 'tombola' will appear as a reference on your card statement.

5.2 MINIMUM DEPOSIT
The minimum account deposit is £10.00 and must be made by using a debit card (Switch/ Maestro, Solo, Delta or Electron) or credit card (MasterCard or Visa). The maximum deposit is £500.00 in any 24 hour period, should your account hold £500.00 we will not accept any further deposits until your account holds £250.00 or less.

5.3 FIRST MONEY MATCH BONUS
Tombola Bonus
1. Players are offered a 100% tombola match bonus on their first deposit up to a maximum of £25.00.
2. Bonus and promotional funds can be used to play bingo90, bingo80, bingo75, Cinco and Battleships (not Hamster Race) on tombola.
3. Bonus funds will be used at a rate equalling 50% of any stake placed.
4. Bonus funds can never be withdrawn.
6. Any unused bonus will be forfeit on closure of an account.

11. The Promoter reserves the right to refuse any offer to any player for any reason, or to withdraw an offer at any time. No correspondence will be entered into.
12. You cannot use Bonus Money to play Hamster Race.

5.4 TOMBOLA RELOAD TERMS AND CONDITIONS
1. Existing players are offered a 100% Reload Bonus with their first deposit after 12.00am on 26th August 2008.
2. Players depositing between £10 and £25 will be matched with the same amount.
Re load Bonus funds can be used to play all tombola games except Hamster Race.
3. Re load Bonus funds cannot be withdrawn and are subject to the standard bonus withdrawal terms.
4. Any un-used Re load Bonus funds will be forfeited on any withdrawal and on closure of account.
5. This offer is valid for players’ who registered on tombola before 23.59 on 25th August. Any subsequent deposits are not eligible for the Reload offer.
6. The Reload bonus is restricted to one per tombola account.
7. tombola reserves the right to refuse or withdraw any offer to any player for any reason at any time. No correspondence will be entered into.


5.5 FREE £5.00 MAGAZINE PROMOTION OFFER
1. Open to new and existing players.
2. The FREE £5 voucher is bonus money.
3. You can not withdraw the FREE £5.
4. Vouchers can only be found in a number of magazines published on the site.
5. New players are required to register their personal details but do not have to enter credit card details or make a deposit.
6. New players will not be able to play Hamster Race or the Free game on tombola.co.uk with their FREE £5 voucher.
7. One FREE £5 voucher per person per magazine issue.
8. All codes are unique and players who enter incorrect codes more than 3 times will be unable to enter their code for a further 24 hours.
9. tombola cannot be held responsible for magazines purchased that do not contain a voucher.

5.6 CREDIT CARD CHARGES
We do not charge for deposits by Debit or Credit cards although customers should note that some Credit Card Companies categorise betting transactions as 'cash' and may levy a fixed and/or interest charge from the date of payment. Please note we accept no responsibility for any charges or fees levied by your card issuing bank or financial institution.




6 VOIDING STAKES/ACCOUNTS

6.1 STAKES DECLARED VOID
In any circumstances where a stake is deemed to be or is declared void under these terms, any sum deducted from your account in respect of that stake shall be credited to your www.tombola.co.uk account.

6.2 CLOSING PLAYER ACCOUNTS
We reserve the right to close an account at any time without explanation. Unused advance payments will be refunded to account holders.

6.3 SUSPICIOUS CARD TRANSACTIONS
If we determine or suspect that a transaction is suspicious and involves or may involve financial crime or similar activity, tombola reserves the right to retain the amount of that transaction and any other transaction made by you. We shall be under no obligation to provide you with any reasons for so doing.

6.4 AUTOMATIC GAME PLAYING / MANIPULATION OF SOFTWARE
Automatic playing of Games by software or any other manipulation of the Games or your/another Player’s account data may result in termination of your membership, deletion of all associated accounts, and the cancellation of any outstanding prizes and deposits. Players that violate this policy will not be eligible for reinstatement under different screen names until further notice.

Players and visitors to the tombola website accept that any tampering by way of, hacking, use of viruses, manipulation of data, use of insider knowledge, or any other method of cheating is a material breach of the Terms and Conditions. tombola (Alderney) Limited retains full rights to recover both, any gains made by person(s) in material breach of the above, as well as any other direct, indirect or consequential losses.



7 FAIR PLAY
Should we decide to waive a rule in the interest of fair play to you, it will not set any precedent for the future.



8 WINNINGS

8.1 WINNINGS
Winnings will be immediately transferred to your account. From the homepage click "My account" then click on "Withdraw funds" and follow the on-screen instructions. To comply with Money Laundering regulations, we are required to confirm proof of identity where a customer withdraws an accumulative amount of £1,000 or more within any 90-day period. Upon reaching an accumulative amount of £1,000 or more you will be required to provide TWO of any of the following documents:

Passport
• Driving Licence
• Header of a bank/credit card statement
• Header of a utility bill (gas, electricity, water, landline phone, council tax)
• Letter from Inland Revenue/DSS/DWP

From www.tombola.co.uk, click on the "Withdraw" option located in "Your Account" and complete the requested details. Please note withdrawals to MasterCards will be remitted by cheque only. Also please note that withdrawal requests over £1000.00 can only be remitted by cheque.

8.2 PUBLICATION OF WINNINGS
We promote winnings paid out to players as part of our promotional efforts. Publicised winnings are for all winnings paid unless otherwise stated.

8.3 BIG WINNER PROMOTIONAL INFORMATION
Winners on the site grant tombola irrevocable right but not obligation to use and publish their proper name and town online and in print, any other media or our promotional agencies to use your details without compensation unless prohibited by law.



9 WITHDRAWALS

9.1 PAYMENT REQUESTS
You must submit your request for payment with a preferred payment method, either debit/credit card payment or cheque payment. tombola reserves the right to choose a preferred payment method and to refuse payment if a person claiming payment is unable to provide evidence proving their eligibility as the named account holder and are authorised to use the credit or debit card which paid for the winning ticket.

9.2 MINIMUM WITHDRAWALS
Due to administration costs, the minimum withdrawal from a player’s account is £10.00 unless a player is closing their account. Players who leave less than £10.00 in their account will be sent monthly reminder emails for a twelve-month period after they last played on the tombola website. The Funds will be left in the player account during this time. After a period of twelve months the account will be defined dormant. Should a dormant account be in credit by more than £2.00 a cheque will be remitted to the player using the player details held on the tombola server. Due to administration costs the minimum withdrawal from a dormant account is £2.00.

9 .3 WITHDRAWALS FROM DEBIT CARD ACCOUNTS
For debit card accounts payment will be made to your card within the normal banking cycle (usually 3-5 working days). For larger transactions we reserve the right to ask you to provide us with copies of proof of identity before a repayment can be made, any withdrawals over £1000.00 can only be remitted by cheque.

9 .4 WITHDRAWALS FROM CREDIT CARD ACCOUNTS
For most credit card accounts, payment will be made to your card within the normal banking cycle (usually 3-5 working days). Note if you use a MasterCard due to card scheme rules, we are unable to repay to your card. Funds will be paid by bank cheque. 9.5 CHANGES TO YOUR PERSONAL DETAILS
Account holders are also responsible for keeping accurate details provided at registration up to date. You can access and amend your own individual account information by clicking on "My Account Details" in the "My Account" area of the site. Should you change your surname and/or address you must provide proof of such change before any account details can be updated.

9.6 CHANGES TO YOUR BANKING DETAILS
If any part of your debit or credit card number changes, including the issue number (where applicable) and expiry date, it is your responsibility to inform us immediately. Failure to do so may result in transactions being declined by your bank, building society or credit card company. We will not accept any liability or responsibility for transactions that are declined as a result of incorrect bankcard details where you have failed to provide us with the changes to your details. Should your debit or credit card be lost or stolen, please contact the customer support team immediately.



10 PROMOTIONAL FUNDS

10.1 PROMOTIONAL PRIZES/COMPETITIONS
In the event that, as part of a promotional campaign or competition, we credit an amount to an account registered in your name, we reserve the right to reclaim any such unused amounts in the event that you fail to access or use that account during any period of six months. Irrespective of where players live in the world, tombola endeavours to deliver all promotional prizes and prizes that have been won to the prize winner's registered address destination or requested address. tombola reserves the right to offer an alternative prize of similar value (including a financial consideration) if it is either impractical or illegal to deliver the relevant prize to the player's relevant country.

10.2 LOCATION SPECIFIC PROMOTIONAL PRIZES
tombola will specify if 'travel costs' are included in a location-specific promotional prize. If not specified as included, a winner must pay his or her own costs to the destination. tombola reserves the right to offer an alternative prize of similar value (including a financial consideration) if it is impractical for the player to travel to a location-based prize. In such cases, tombola will attempt to offer a similar type of prize at a location nearer to the player but tombola reserves the right alternatively to offer a financial consideration prize.



11 PAYOUTS

11.1 PAYOUT RATES
We reserve the right, at our discretion, to make changes to the payout rates applying to all tombola games.

11.2 REFUSAL OF STAKES
We reserve the right to refuse the whole or part of any stake without explanation.



12 RANDOM NUMBER GENERATOR (RNG)

You fully accept and agree that random number generator software will determine the outcome of the Games. External IT experts check tombola random number generator periodically. External accountants check tombola accounting and financial systems. tombola winnings and withdrawals are audited by external accountants to ensure tombola pays out monies owed to Players.



13 OUR LIABILITY

Card Liability

14 GOVERNING LAWS AND DISPUTES

These terms shall be governed by and construed in accordance with Alderney Law. We are not authorised to arrange transactions in investments or otherwise engage in the conduct of investment business. You may not use our services for any business, commercial or investment purpose.



15 COPYRIGHT

You agree that tombola (Alderney) Limited is the sole owner of all rights to technology, software and business systems utilised in this website and that your use of this website (and registration thereon) confers no rights whatsoever to intellectual property contained or utilised therein. Use or publication by you of any item displayed on this website is strictly prohibited.

Under section 81 of the Gambling (Interactive Gaming) (Alderney) Ordinance, 2001 [prohibition of interactive gaming], the Commission may issue an order prohibiting a person who is a registered player from participating in an interactive gaming session in Alderney. In the event that such an order is issued, the Commission will notify www.tombola.co.uk of the exclusion. On receipt of such notification, www.tombola.co.uk is required to ensure that stakes are not accepted from that person whilst the exclusion order is valid. Where such an exclusion order is in place, tombola will repay that person their tombola account balance, provided the funds have cleared. Where the Commission issues an order revoking the exclusion order, the Commission will inform www.tombola.co.uk of the revocation. www.tombola.co.uk will update its records immediately and permit the person to gamble. Any person excluded from participating for whatever reason shall not be entitled to participate on www.tombola.co.uk whilst the exclusion is in force.

16.3 DATA COLLECTION
To deposit funds and place stakes on the Sites, you will be asked to enter User Information. Such User Information will only be used for the purposes as set out in this Privacy Policy.

19 SETTING YOUR OWN DAILY AND WEEKLY LIMITS

Player's are able to set their own weekly and daily deposit limits.
To do this simply go to 'My Account', and then click on 'Responsible Gambling'.
Daily Limits - minimum you can set is £10.00 - Maximum you can set is £500.00
Weekly Limits - minimum you can set is £10.00 - Maximum you can set is £500.00
A week runs from midnight on Monday to 23.59.59pm on the following Sunday.
Our current policy is that a maximum that anyone can deposit in a week is £500.00
If you increase your limits this will take 24 hours to come into effect.
If you decrease your limits they will immediately come into effect.
We endeavour to ensure players cannot deposit more money than the limit they set but we will not reimburse any player who for technical reasons are able to spend more than their limit.



20 SELF EXCLUSION
